UAB Hospital in Birmingham, Alabama is no longer requiring staff members to be vaccinated for COVID-19 to continue working after the legality of the mandate was brought into question. Last week, the Alabama Center for Law and Liberty said in a letter that the mandates violated state law due to the state of Alabama's ban on vaccine passports, according to Al.com. The letter said this: “As the Supreme Court of Alabama has recognized, UAB Hospital is a state-run hospital. Consequently, UAB Hospital may not require its employees to disclose whether they have been vaccinated or not. Likewise, the Alabama Attorney General has examined the law and concluded that ‘no government, school, or business in Alabama may demand that a constituent, or customer, respectively, be vaccinated for COVID-19 or show proof of his or her vaccination for COVID-19.'" UAB first announced their mandate on August 9th. Just over a month later, on September 10th, Joe Biden announced a vaccine mandate for all businesses with over 100 employees, including those in the private sector. After his announcement, the Biden administration was hit with heavy backlash, leading to an even larger uprising against vaccine mandates. This has led to legal challenges and job walk-outs all over the U.S. In addition, Alabama Attorney General Steve Marshall announced September 16th that the state of Alabama would be suing the Biden administration for the mandate if it was not dropped. Alabama is one of several states that have threatened to sue Biden over the mandates. Arizona has already filed suit. “The vaccine mandate is unprecedented in its audacity and unlawful in its application,” Marshall said. “The Biden administration knows this full well. The State of Alabama will not allow such an authoritarian power grab to go unchecked." UAB released a statement explaining the policy change, saying: “President Biden issued an executive order Sept. 9 indicating that federal rules and regulations will be issued in the coming weeks that will require COVID vaccines for workers at health care facilities that receive Medicare or Medicaid dollars. Because UAB Health System must follow federal law, UAB Health System will remove its vaccine policy at this time. UAB Health System will wait for the detailed federal guidance to develop a replacement vaccine policy in order to ensure full compliance with federal law.” The statement also noted that employees who receive the vaccine voluntarily will receive a $400 bonus. This policy was in place before the mandate. Hospitals in Alabama have been functioning fine without the mandates, according to Dr. Don Williamson, president of the Alabama Hospital Association. He claimed that vaccine rates at AL hospitals are already high, ranging from 50% to 80%, depending on the facility. You may feel that you are fighting mandates alone, but don't give up.
