Credit to Lehigh University Article by Haddon Lockyer A Superior Court Judge blocked the Los Angeles Unified School District's vaccine mandate for students, stating that the school district did not have the authority to enforce COVID-19 vaccination mandates that exceeded those of the state of California. The board has been discussing the mandate for months, but decided to delay their plans to July 2023, as the state of California did with their own vaccine mandate. Even so, the board maintained their support (and even their desire) to see the mandate go into effect. The court decision was celebrated by Let Them Breathe, a California group that has worked to remove mask and vaccine mandates from CA schools. Arie L. Spangler, a legal representative for Let Them Breathe, said this of the ruling: “Judge Beckloff’s ruling confirms that individual school districts do not have the authority to impose local vaccination requirements in excess of statewide requirements. We are very pleased with the ruling, as it ensures that no child will be forced out of the classroom due to their COVID-19 vaccination status.” If the mandate would have been allowed, unvaccinated students would have been forced to take online courses rather than being able to attend in-person schooling with their peers. A mandate remains in effect for the district's staff, however, meaning that all staff currently employed by the district have been vaccinated. Those who refused to comply were fired. It is unclear whether or not the board will appeal the court's decision.
Credit to CalMatters Speaking of his decision, Judge Beckloff claimed that he didn't originally see the policy as a mandate, as unvaccinated students would still receive their required courses. Upon finding out that an unvaccinated student would be kicked from a science program because of their vaccination status, however, he changed his mind. "If D.F. remains unvaccinated, he will be required to leave his current school with its curriculum and programs to be enrolled in a new school within the district ... where it appears his curriculum would be very different than at his current school. Thus, the Resolution is not merely about how education is delivered or who may be physically present on campus as the court previously viewed it. Instead, the Resolution dictates which school the student may attend, and the curriculum he may continue to receive.” The news of this ruling comes as parents across the country continue to fight back against mask and vaccine mandates that are still in place.
